The lawyer profession is a self-employment activity. Attorney's fee refers to the amount or value that corresponds to the legal aid of the lawyer. Lawyers offer their knowledge and experience in the field of law to the benefit of people. As in every profession, legal consultancy and other legal services are subject to a fee. Paying a lawyer is also a legal obligation, and it is prohibited to make a wage contract below the amounts specified in the attorney's minimum wage tariff.
Attorney fees cannot be determined under the minimum attorney fee tariff. In the event of a free case, the situation is reported to the board of directors of the bar association.
The lawyer fee can be determined in two ways;
It is the fee payable according to the attorney's fee agreement freely arranged between the parties (between the lawyer and the client). There are also legal restrictions on the fee determined by such contracts. The wage to be determined in a freely arranged wage contract cannot be less than the Minimum Wage Tariff and cannot exceed 25% of the case value.
In cases where the attorney's fee has not been agreed or there is no written fee agreement between the parties, or the wage agreement is not clear or controversial, or the provision of the wage agreement on wages is deemed invalid; For lawsuits and works whose value can be measured with money, an amount between ten percent and twenty percent of the value of the lawyer on the date of finalization of the lawsuit is determined by the competent authority to examine wage objections for the won part of the case. In cases and jobs whose value cannot be measured with money, the minimum fee for attorneys will be applied.
