Case for Denial of Kinship

The father of the child who is born within three hundred days after the marriage is continuing or after the end of the marriage is the male spouse. The acceptance that the child belongs to the husband is called "presumption of paternity". After this period, the attachment of the child to the male spouse is possible with the proof that the mother conceived during the marriage. If the husband claims that the child is not from him, he can file a case for denial of paternity and refute the presumption of paternity. The denial of paternity case can be filed against the mother and child. The child also has the right to file an action for denial of paternity. This lawsuit is filed against the mother and husband.

Periods in the case of denial of paternity

The husband has to open the case within one year, starting from the date of birth and earning that he was not a father or that the mother had sexual intercourse with another man when she was pregnant. The child has to file a lawsuit within one year, starting from the date of adulthood.
