How is the Attorney's Fee Determined in Divorce Cases in Turkey?

The attorney's fee in divorce cases is determined according to the time, labor and knowledge capital the attorney will spend and the responsibility he will assume. For example, contested divorce cases can be concluded in an average of 1-2 years at the local court stage, and can take up to 3-5 years with the appeal and cassation processes. During this process, the divorce attorney must write a petition, response petitions, evidence petition, declaration petitions, petitions requesting protection and prevention measures if necessary, requests for establishing personal contact with the joint child, appeal and cassation petitions, and review current Supreme Court decisions on some specific issues. When all these petitions are considered together, the divorce attorney will provide dozens of petitions and participate in many hearings to be held throughout the process on behalf of the client.

When the petitions to be written, the hearings to be attended and the scanning activity to be carried out regarding the current Supreme Court decisions are included, the working hours to be spent by a divorce lawyer for a single contested divorce case within a period of 2-3 years can reach 80-100 hours. Here, the divorce case fees are also determined as a result of this labor/time accounting and each lawyer determines the fee according to his/her own work organization, activity structure and the requirements of the job to be undertaken in accordance with the tariffs published by the bar associations.

In this regard, it should not be forgotten that the words of Abraham Lincoln, a former president of the United States who was also a lawyer, are perhaps a bit exaggerated but are undoubtedly true: "A man who represents himself, has a fool for a client."

Therefore, regarding the property division case to be held after the alimony, compensation, custody and divorce case, we recommend that all our citizens who are parties to these legal processes definitely consult a lawyer and receive legal consultancy and case representation services in order not to suffer any loss of rights. In addition, it should not be forgotten that the property regime agreement made between the parties, known among the public as the marriage contract, will be taken into consideration in the property division case.
