The most fundamental difficulty in crimes committed during communication between people face-to-face or through a means of communication arises in terms of proof. Crime victims who want to prove these non-public conversations, which are mostly between two people, want to request protection from the judicial authorities by making a confidential audio recording. But in terms of fundamental rights, as a rule; Audio recordings taken unannounced from a person cannot be used as evidence in court as they are unlawful evidence, and making these recordings also constitutes a crime. There are two main exceptions to this situation.
The first of these is seen in divorce cases and the second in criminal cases. In the case law of the Court of Cassation, it is stated that "voice recordings taken without the knowledge of the other party" can be used as evidence in divorce and criminal cases.
